Future Bay Factory LLC

Fort Lauderdale, FL 33309
United States of America
Email: office@futurebayfactory.com
For personal project-related communication with the founder, bianca.neubauer@futurebayfactory.com may also be used. Privacy requests should preferably be sent to the general company address.
2. Scope
This policy applies to this website, its related project pages, and business inquiries prepared by email or through the contact form offered on the website. It does not apply to independent third-party websites that are merely linked.
3. Categories of Personal Information
Depending on your use, the following categories of data may in particular be processed:
- contact and identification data, such as name, email address, company, position, and stated role;
- communication and inquiry data, including message content, project interest, and correspondence;
- technical usage and connection data, such as IP address, date and time, browser, operating system, device type, referrer, and requested files;
- business relationship and documentation data generated in connection with an inquiry, qualification, confidentiality agreement, or cooperation.
Please do not submit sensitive personal information through general contact channels unless this is expressly necessary and has been agreed in advance.
4. Purposes of Processing
We process personal information in particular to:
- provide the website securely, reliably, and functionally;
- respond to inquiries and conduct business communications;
- review and qualify strategic contacts, partner inquiries, and project inquiries;
- prepare pre-contractual measures, confidentiality agreements, and potential business relationships;
- comply with legal obligations, protect rights, and prevent misuse or security incidents;
- manage internal business records and traceable correspondence.
5. Legal Bases
In the United States, processing is carried out for permissible business purposes, to handle inquiries, to perform or prepare contracts, with consent, to comply with legal obligations, and to protect legitimate business and security interests.
Where the European Union General Data Protection Regulation or comparable European rules apply, we rely in particular on Article 6(1)(b) GDPR for contractual or pre-contractual measures, Article 6(1)(f) GDPR for legitimate interests, Article 6(1)(c) GDPR for legal obligations, and Article 6(1)(a) GDPR for freely given consent.
Where the Brazilian LGPD applies, processing is carried out on an applicable lawful basis, in particular for the performance of contracts or pre-contractual measures, compliance with legal obligations, protection of legitimate interests, or on the basis of consent.
6. Website Hosting and Server Logs
When the website is accessed, hosting, infrastructure, and security providers may process technically necessary connection data. This data is used to deliver the website, maintain system security, analyze errors, and defend against abusive access. Recipients may be located in the United States or other countries.
7. Contact Form and E-Mail Communication
When you contact us by email, we process the information you provide to handle the inquiry and continue business communications.
The contact form does not transmit information to a website or CRM service. On submission, the browser prepares a pre-addressed email to bianca.neubauer@futurebayfactory.com and passes it to the locally configured email application. Information is transmitted only when you send the email from that application.
8. External Fonts and Technical Resources
The website currently loads fonts through Google Fonts and Fontshare. When such external resources are requested, technical connection data, particularly the IP address and browser information, may be transmitted to the respective providers. Providers may process data outside your country of residence. Hosting the fonts locally at a later stage may avoid these external requests.
9. Cookies, Analytics and Advertising
At the current technical stage, we do not use analytics, marketing, or targeted advertising services and do not set our own non-essential tracking cookies. Technically necessary storage or logs generated by browsers, hosting, or security infrastructure may remain unaffected.
10. Disclosure to Service Providers and Other Recipients
Where necessary, personal information may be disclosed to hosting, infrastructure, email, IT, security, and professional advisory providers, as well as to authorities or legal advisers. Service providers receive only the data required for their tasks and, where legally required, are contractually bound to appropriate data protection obligations.
11. International Data Transfers
Future Bay Factory LLC is based in the United States. Data relating to individuals in the European Economic Area, the United Kingdom, Switzerland, Brazil, or other countries may therefore be transferred to and processed in the United States or other countries. The level of data protection may differ from that in your country of residence.
Where legally required, we use appropriate transfer mechanisms and safeguards, such as contractual data protection clauses, additional technical or organizational measures, or statutory exceptions. Information about specific safeguards may be requested at office@futurebayfactory.com.
12. Data Retention
We retain personal information only for as long as necessary for the relevant purpose. General inquiries that are not pursued are usually deleted no later than 24 months after receipt. Business, contractual, legal, or tax-relevant records may be retained for longer where required by legal obligations, limitation periods, or legitimate documentation interests. Thereafter, data is deleted, anonymized, or securely restricted.
13. No Sale, Targeted Advertising or Automated Decisions
We do not sell personal information. We do not disclose personal information for behavioral or targeted advertising. The website does not make solely automated decisions that produce legal or similarly significant effects for visitors.
14. Regional Privacy Rights
United States
Depending on your U.S. state and applicable statutory thresholds, you may have rights to access, correct, delete, or obtain a portable copy of personal information, restrict certain processing, opt out, or appeal a decision. Because we currently do not sell personal information or engage in targeted advertising, no corresponding sale or advertising opt-out is presently required in that respect.
European Economic Area, United Kingdom and Switzerland
Where applicable, you may request access, correction, deletion, restriction, data portability, and objection. Consent may be withdrawn at any time with effect for the future. You may also lodge a complaint with a competent data protection authority.
Brazil
Where the LGPD applies, data subjects may in particular request confirmation of processing, access, correction, anonymization, blocking or deletion of unlawfully or excessively processed data, data portability, information about recipients, and withdrawal of consent.
To exercise your rights, please send a verifiable request to office@futurebayfactory.com. We may request reasonable information to verify your identity. Statutory exceptions and retention obligations remain reserved.
15. Children’s Privacy
This website and the projects presented are not directed to children. We do not knowingly collect personal information from children under 13. Individuals under 18 should submit personal information only with the consent and supervision of a parent or legal guardian.
16. Data Security
We use reasonable administrative, technical, and organizational measures to protect personal information against loss, misuse, unauthorized access, alteration, or disclosure. No electronic system can, however, guarantee absolute security.
17. Third-Party Links
Linked third-party websites and services are governed by their own privacy practices. Future Bay Factory LLC is not responsible for their processing activities.
18. Changes and Language Versions
We may update this privacy policy if legal requirements, website functions, hosting, service providers, or processing activities change. The version published at the relevant time is authoritative. Translations are provided for international accessibility; in the event of discrepancies, the English version shall prevail to the extent permitted by law.
